Planning Board Minutes 10/25/06
Minutes of Meeting— October 25, 2006

The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 6:30 p.m., Chairman Robert D’Amelio called the meeting to order.
Present:        Tom Collins, Robert D’Amelio, Rodney Frias, Dirk Underwood and Jennifer Burke

Petitioned Article 14 – Rezone 281 Washington Street
Present was:    Arthur Bergeron, Atty. at Law
                
Atty. Bergeron presented the article to the Planning Board.  His client is proposing to rezone her property M-6, which is industrial zoning.  He noted that the Town line splits the lot and that the portion in Marlboro is zoned limited industrial.  This proposal will make the whole lot consistent.  He noted the home occupation that is in use on the site.

Mr. D’Amelio noted a couple of concerns.  He stated that just up the street a new Walgreens is proposed and is under site plan review.  He is concerned that the Board is arguing traffic with Walgreens and to support the rezone of this land with go against that argument.  He also noted that he would have liked to see a larger area looked at and proposed.  The idea of zoning one lot at a time is not good.

Atty. Bergeron asked if his client worked with other landowners to propose a rezone of the area would the Board prefer that scenario.  Mr. D’Amelio said that would be better.

Ms. Burke noted that it is better planning to look at a whole area vs. one lot for rezoning.

Barbara Masciarelli, 15 Maxwell Circle, ask what does M-6 zoning mean.  What would the petitioner be able to do with her land?  She was told anything except multi-family uses.  Ms. Masciarelli expressed concern if she sells 3-4 years from now and what could go there.

Steve Domenicucci, 5 Hearthstone Drive, stated that he was not concerned about traffic but about the residents in the area and how this would affect them.  He also expressed concern that if the article passes at Town Meeting and then the petitioner changes her mind and decides to build something bigger.

John Parent, 27 Causeway Street, asked if this would be considered spot zoning.  He was told no because the proposal is to extend the zone across the street.

Ms. Masciarelli asked if the attorney general could deny the proposal as spot zoning.  She was told that he could but Aldo may be able to clarify the article for the attorney general.

Colleen Cappucci, 281 Washington Street, the petitioner arrived at 7:05 p.m.  Atty. Bergeron reviewed with his client the proceedings to this point.  Ms. Cappucci stated that she does not feel her property is affected by traffic.  Atty. Bergeron reviewed the Planning Board’s options with his client and what the implications of the Planning Board’s action are.

Atty. Bergeron again asked about the rezoning the whole area as a new zone.  Mr. D’Amelio indicated he does not know the concerns of the rest of the community.

Ms. Masciarelli asked if zoning descriptions were set by the state.  She was told no.  Each town sets it’s own definitions and standards.

Rodney Frias, seconded by Dirk Underwood, made a motion to close the public hearing for the petitioned article to rezone 281 Washington Street.

Vote: 4-0-0, Unanimous

The Board took no action.

Adjournment

Robert D’Amelio, seconded by Tom Collins, moved to adjourn at 7:30 pm.
